ABN 50 677 089 628 Trusion Deposit and Supply Terms

Deposit and Supply Terms

These terms apply to the supply of products only by Trusion. They do not cover installation, construction, building, or other contract work.

1. Application and Acceptance

1.1 These terms apply to all quotations, invoices, orders, and supplies made by Trusion unless otherwise agreed by Trusion in writing.

1.2 The customer accepts these terms by signing an acceptance, approving a quotation or invoice, paying a deposit, placing an order, or otherwise instructing Trusion to proceed.

1.3 If there is any inconsistency between these terms and any specific written terms on a quotation or invoice issued by Trusion, the specific written terms on that quotation or invoice prevail to the extent of the inconsistency.

2. Supply Only

2.1 Trusion supplies products only. Trusion does not carry out installation, construction, building, site works, or any other contract work.

2.2 The customer is responsible for confirming measurements, quantities, finishes, specifications, delivery details, site suitability, approvals, and installation arrangements before placing an order.

2.3 Any product, technical, or installation information provided by Trusion is general information only and is not site-specific advice. The customer should obtain independent professional advice where required.

3. Orders and Specifications

3.1 The customer must carefully review all order details before paying the deposit, including product type, finish, size, dimensions, quantities, accessories, freight, and delivery address.

3.2 An order is not confirmed until Trusion has received the deposit in cleared funds and the final order details have been approved.

3.3 Once an order is confirmed, Trusion will process the order based on the approved details.

3.4 Any requested changes after an order has been confirmed may be refused, may cause delays, and may result in additional charges.

4. Price, Deposit and Balance

4.1 Unless otherwise stated in writing on the quotation or invoice, the required deposit is 50% of the total sale price shown on the invoice.

4.2 The remaining 50% balance must be paid in full before dispatch or collection unless Trusion agrees otherwise in writing.

4.3 Trusion may withhold dispatch, delivery, or collection of goods until all amounts owing have been paid in full.

5. Estimated Lead Time

5.1 The estimated lead time for an order is approximately 8 to 10 weeks from the date Trusion receives the deposit in cleared funds and final order confirmation.

5.2 Lead times are estimates only and are not guaranteed. They may be affected by manufacturing schedules, supplier availability, freight delays, shipping delays, customs, port congestion, weather events, or other circumstances outside Trusion's reasonable control.

5.3 If Trusion becomes aware of a material delay, Trusion will notify the customer as soon as reasonably practicable and provide an updated estimated arrival timeframe.

5.4 Nothing in this clause limits any rights the customer may have under the Australian Consumer Law if goods cannot be supplied within a reasonable time.

6. Cancellation, Deposits and Refunds

6.1 Once the deposit has been paid and the order has been processed, Trusion may commence or commit to manufacturing, procurement, production scheduling, supplier orders, and freight arrangements specifically for that order.

6.2 Because those steps involve real costs and commitments being made for the customer's order, the 50% deposit is non-refundable if the customer cancels the order or changes their mind after the order has been processed, except to the extent required by law.

6.3 The deposit reflects costs, liabilities, and commitments incurred by Trusion in processing and fulfilling the order.

6.4 A requested cancellation or variation after processing has commenced may not be accepted. If accepted, it may result in additional charges, a revised lead time, or both.

7. Delivery, Collection, Risk and Title

7.1 Any dispatch, delivery, or collection dates given by Trusion are estimates only unless expressly confirmed by Trusion in writing.

7.2 The customer must ensure accurate delivery information, reasonable site access, and any necessary arrangements for unloading or receipt of goods.

7.3 Risk in the goods passes to the customer upon delivery to the nominated address or upon collection, whichever occurs first.

7.4 Title to the goods does not pass to the customer until Trusion has received full payment of all amounts owing in cleared funds.

7.5 The customer should inspect the goods promptly on delivery or collection and notify Trusion within a reasonable time if there is any apparent damage, shortage, or supply issue. This clause does not limit any rights the customer may have under the Australian Consumer Law.

8. Non-Payment and Storage

8.1 If the customer does not pay the balance when due, Trusion may suspend supply, delay dispatch, cancel collection arrangements, or store the goods at the customer's cost until payment is made.

8.2 Any reasonable storage, redelivery, or recovery costs incurred by Trusion because of late payment or failure to collect may be charged to the customer.

9. Australian Consumer Law

9.1 Nothing in these terms excludes, restricts, or modifies any guarantee, right, or remedy that cannot lawfully be excluded, restricted, or modified under the Australian Consumer Law or any other applicable law.

9.2 If a customer is entitled to a remedy under the Australian Consumer Law, those rights will apply despite anything else in these terms.

10. General

10.1 These terms are governed by the laws of New South Wales, Australia.

10.2 If any part of these terms is invalid or unenforceable, that part is to be read down or severed to the extent necessary, and the remaining terms continue in full force and effect.

10.3 These terms may only be varied by Trusion in writing.
